Eligibility criteria for Surrogacy

For Intended Parents (IPs)/ Intending woman

Medical Need: There must be a proven medical reason why IPs need gestational surrogacy.

Citizenship and Age:

  • Couples: Both partners must be of Indian origin, legally married, and within the specified age range:
  • Female: 23 to 50 years old on the day of certification.
  • Male: 26 to 55 years old on the day of certification.
  • Single Women: Indian widows or divorcees between 35 and 45 years old.

Prior Children: IPs generally cannot have a surviving biological, adopted, or surrogate child.

Exception: IPs with a child who has a mental or physical disability, life-threatening disorder, or terminal illness (with no cure) may be considered with approval and medical documentation.

  • Marital Status and Children: She must be married and have at least one child of her own.
